Matilda Weaves is dedicated to offering a curated selection of handcrafted products sourced directly from artisans across India. We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our services for personal, non-commercial purposes, in accordance with these Terms.

Prohibited Activities

You agree not to engage in any of the following activities while using our services:

• Unauthorized Use: Attempting to gain unauthorized access to any portion of the website, user accounts, computer systems, or networks connected to the Matilda Weaves platform through hacking, password mining, or any other means.

• Violation of Laws: Using our services in any manner that violates applicable local, state, national, or international laws or regulations.

• Interference: Interfering with or disrupting the operation of the website, servers, or networks, including transmitting any viruses, malware, or other harmful code.

• Misrepresentation: Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

 Matilda Weaves allows users to contribute content such as reviews, ratings, comments, and other forms of feedback (“User Content”) to enhance the community experience. By submitting User Content, you agree to the following terms: 

• Accuracy and Lawfulness: You represent and warrant that your User Content is accurate, lawful, and does not infringe on the rights of any third party.

Matilda Weaves grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site Content for personal, non-commercial purposes. This license does not allow you to:

• Modify, reproduce, or create derivative works based on the Site Content without express written permission.

•  Use the Site Content for any commercial purpose, including reselling, distributing, or displaying it in public without authorization.

Product Information and Availability

 Matilda Weaves strives to provide accurate and up-to-date information about our products. However, we do not warrant that the product descriptions, images, or other content on our website are accurate, complete, reliable, current, or error-free. If a product offered by us not as described, your sole remedy is to return it in unused condition in accordance with our Return & Cancellation policy. 

Product availability is subject to change without notice. We make every effort to display current and accurate stock levels on our website, but we cannot guarantee that a product listed as “in stock” will be available for immediate shipment. 

Our products are handmade and may have slight variations in color, size, and design. These variations are not considered defects but rather a testament to the unique, handcrafted nature of each item. 

Pricing & Payment Terms

 • Currency: All prices displayed on the website are in INR (Indian Rupees) unless otherwise noted. Prices are subject to change without notice.

• Taxes: Prices do not include applicable taxes, duties, or fees. These will be calculated at checkout based on your shipping address and applicable laws.

• Pricing Errors: Matilda Weaves reserves the right to correct any errors in pricing or product information. If a product’s correct price is higher than the price shown on our website, we will contact you for instructions before processing your order or cancel the order and notify you of such cancellation.

 • Accepted Payment Methods: We accept various payment methods, including credit/debit cards, net banking, UPI, and digital wallets. All payments must be made in full at the time of purchase.

• Payment Security: We use secure payment gateways to process your transactions, ensuring that your payment information is encrypted and protected from unauthorized access.

Shipping, Returns & Cancellations, and Limitation of Liability. 

 Shipping Policy

Matilda Weaves offer a variety of shipping options to accommodate our customers’ needs. Shipping costs and delivery times vary based on the shipping method selected and the destination of the order.  

Domestic Shipping: For orders within India, we offer standard and expedited shipping options. Shipping charges will be calculated at checkout based on the weight, dimensions, and destination of your order  

• Order Processing: Orders are typically processed within 2-5 business days. During peak periods or sales events, processing times may be longer. You will receive a confirmation email once your order has been shipped. Since some of our items are made to order it might take 15 -30 days to process the order.

• Delays: While we strive to ensure timely delivery, Matilda Weaves is not responsible for delays caused by unforeseen circumstances such as weather conditions, customs clearance, or courier service issues.

Order Track:

Once your order has been shipped, you will receive a tracking number via email. You can use this tracking number to monitor the status of your shipment on the courier’s website. If you encounter any issues with tracking your order, please contact our customer service team for assistance. 

Policy of Return

Matilda Weaves is committed to ensuring customer satisfaction with our products. 

• Eligibility for Returns: Items must be unused, in their original condition, and with all original packaging and tags intact. Certain items, such as personalized or custom-made products and jewelleries are non-returnable.

• Return Process: To initiate a return, please contact our customer service team with your order number and reason for return. You will receive instructions on how to return your item(s). Return shipping costs are the responsibility of the customer unless the item is defective or incorrect.

• Refunds: Refunds will be issued to the original payment method within [10 business days] of receiving the returned item. Shipping charges are non-refundable unless the return is due to an error on our part.

Sizing

The fit of our clothing depends on the cut, fabric and style of each garment. Some garments are designed to have a looser, relaxed fit and some garments are styled to be more fitted. Please review our sizing guide to select the size best suited to you.

Product Wash & Care and it's Properties:

Matilda Weaves products are handcrafted using the finest natural fibres. The subtle variations in color, texture and finish are intrinsic to hand made products. Our products involve crafts-based traditions of hand spinning, dying, weaving, wood block printing and embroidery. We use both vegetable dyes and commercial dyes with the goal of minimizing our impact on the environment while striving for the best color properties. An irregular weave or print is not a defect - hand-loom by definition means uncertainty when it comes to uniformity.

Colors: We have done our best to display as accurately as possible the colors of the products shown on this Web site. However, because the colors you see will depend on your screen monitor, we cannot guarantee that your monitor's display of any color will be accurate.

Some colors like reds and blues tend to run and rub. Please always hand wash them separately in cold water and dry inside out in shade. We recommend dry clean for first few washes.

Cancellation Policy

• You may cancel your order for a full refund if the order has not yet been processed or shipped. Once an order has been processed, it cannot be cancelled, but you may return the item in accordance with our return policy.

• To cancel an order, please contact our customer service team as soon as possible. If the order has already been shipped, you will need to follow the return process once you receive the item.

Disclaimer of Warranties

Matilda Weaves provides its website, services, and products “as is” and “as available,” without any warranties, either express or implied, including but not limited to implied warranties of merchantable, fitness for a particular purpose, and non-infringement. While strive to provide accurate and timely information, we do not warrant that the content on our website is accurate, complete, reliable, or current. 

Limitation of Liability

 To the fullest extent permitted by law, Matilda Weaves its directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

• The use or inability to use the Matilda Weaves website or services.

• Unauthorized access to or alteration of your transmissions or data.

• Any errors or omissions in the content provided on the website.

• Any product defects or failures, except as expressly provided in our return policy.

• In no event shall Matilda Weaves total liability to you for any damages, losses, or causes of action exceed the amount you have paid to Matilda Weaves in the last six months, or INR 5,000, whichever is greater. 

Indemnification

You agree to defend, indemnify and hold Matilda Weaves and its affiliates harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the site. 

Government Laws

The Terms & Conditions and any disputes arising out of or related to the use of the Matilda Weaves website or services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. 

Jurisdictions

You agree that any legal action or proceeding between you and Matilda Weaves for any purpose concerning these Terms or the parties’ obligations hereunder shall be brought exclusively in a court of competent jurisdiction located in Kolkata , India. You consent to the jurisdiction of and venue in such courts and waive any objection to the laying of venue of any such litigation. 

Resolution of Disputes

 In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Matilda Weaves  services, the parties agree to first attempt to resolve the issue through informal negotiation. If the dispute cannot be resolved through negotiation, the parties agree to participate in mediation with a neutral third party before pursuing any other legal remedies. 

Arbitration agreement shall be conducted under the rules then prevailing under the Indian Arbitration Act 1996. The arbitrator's award shall be binding and may be entered as a judgment at Kolkata Court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Termination Terms

Matilda Weaves reserves the right, at its sole discretion, to terminate your account and your access to the website or services, with or without cause and without prior notice, for any reason, including but not limited to a violation of these Terms.  Upon termination, your right to use the services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.  You may terminate your account at any time from Matilda Weaves website or by contacting our customer service team. Termination does not relieve you of any obligations under these Terms, including any payment obligations for orders already placed. 

Other Terms and Provisions

• The Terms & Conditions, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and Matilda Weaves regarding the use of our services. Any other agreements, understandings, or representations, whether oral or written, are superseded by these Terms. 

• If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severe from these Terms and shall not affect the validity and enforceable of any remaining provisions. 

• The failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by a duly authorized representative of Matilda Weaves.

• Matilda Weaves shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war, terrorism, labor disputes, internet service interruptions, or government actions. 

• You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Matilda Weaves. 

• Matilda Weaves may assign or transfer its rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
